Terms of Use

These Terms of Use ("Terms") govern your use of the MyBody website, Care Quiz, Guide directory, Guide profiles, application process, matching services, and related features and communications (collectively, the "Services").

MyBody is operated by Whole Collective LLC, doing business as MyBody ("MyBody," "we," "us," or "our").

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. About MyBody

MyBody is an intentional wellness discovery platform designed to help people ("Seekers") discover practitioners and other wellness professionals ("Guides") based not only on what they offer, but also on factors related to the experience of working with them.

MyBody provides Guide profiles and discovery tools, including a Care Quiz through which Seekers can tell us more about what they are looking for. MyBody may then surface Guides who appear to align with that information.

2. MyBody Is Not a Healthcare Provider

MyBody does not itself provide medical, mental health, therapeutic, diagnostic, or other healthcare services.

Information provided through MyBody, including Guide profiles, Care Quiz questions, matching results, and other content, is for discovery and informational purposes. It is not medical advice, diagnosis, treatment, a treatment plan, or a substitute for advice from an appropriately qualified professional.

MyBody does not determine whether a particular treatment, modality, or Guide is medically or clinically appropriate for you. You are responsible for deciding whether to contact or work with a Guide and for seeking appropriate professional advice for your circumstances.

MyBody is not an emergency or crisis service. If you believe you are experiencing a medical or mental health emergency, contact 911 or another appropriate emergency service.

3. Care Quiz and Guide Matches

The Care Quiz allows Seekers to share information about what they are experiencing, what they are looking for, their preferences regarding care and practitioner relationships, and practical considerations.

MyBody may use a combination of technology, algorithms, artificial intelligence tools, and human review to identify Guides who may align with the information you provide. At launch, recommendations are human-reviewed.

A MyBody match is a discovery suggestion. It does not guarantee that:

• A Guide is appropriate for your particular circumstances.
• A Guide will accept you as a client.
• A service or modality is medically or clinically appropriate.
• You will feel personally compatible with a Guide.
• Working with a Guide will produce a particular result.
• Information supplied by a Guide or Seeker is complete or applicable to your situation.

You remain responsible for evaluating whether to contact, engage, or continue working with any Guide.

4. Guides Are Independent

Guides listed on MyBody are independent practitioners or businesses. Unless expressly stated otherwise, Guides are not employees, agents, partners, or representatives of MyBody, and MyBody does not direct or control the professional services they provide.

Any professional or service relationship you enter into with a Guide is between you and that Guide.

Guides are responsible for their own services, recommendations, professional conduct, scheduling, fees, informed-consent obligations, insurance, recordkeeping, licenses or certifications where applicable, scope of practice, and compliance with laws and professional standards applicable to their work.

MyBody does not currently book appointments on behalf of Guides or process payments from Seekers for Guide services. If you choose to work with a Guide, booking, payment, and other arrangements are handled directly with that Guide or through services selected by that Guide.

5. Guide Curation and Verification

MyBody is intentionally curated. We seek Guides with legitimate practices or offerings who demonstrate a thoughtful point of view, intentionality in their work, and genuine care for the people they support.

Our application and onboarding process may include reviewing a Guide's professional website, social presence, existing listings, or other evidence of their practice; speaking directly with the Guide; reviewing information and materials they provide; and, where applicable, verifying a professional license.

However, not every Guide is a licensed healthcare professional, and not every wellness modality requires professional licensure. MyBody does not conduct comprehensive background checks or independently verify every statement, credential, certification, methodology, or representation made by every Guide unless expressly stated.

Inclusion on MyBody is not a medical endorsement, certification, guarantee of quality, or representation that a Guide is appropriate for every person or circumstance.

Seekers should independently ask Guides about any credentials, licensure, experience, methodology, scope of practice, fees, or other information important to their decision.

6. Guide Profiles

MyBody Guide profiles are created through an editorial process that may include information supplied by the Guide, interviews conducted by MyBody, publicly available information, and collaborative review.

Guides are given an opportunity to review and approve their profile copy before publication and may request reasonable updates or removal of their profile.

Guide practices can change. Availability, pricing, services, qualifications, locations, licenses, certifications, scheduling information, and other details may change after a profile is published. Seekers should confirm information that is important to them directly with the Guide.

7. Guide Applications and Participation

Submitting an application does not guarantee acceptance or publication on MyBody.

Guides applying to or participating in MyBody agree to provide information that is accurate and not misleading and to notify MyBody of material changes that could make their published profile materially inaccurate.

MyBody may decline an application or remove, suspend, or decline to continue publishing a Guide when we reasonably believe it is appropriate, including because of inaccurate or misleading representations, material concerns about credentials or services, repeated or credible complaints, safety concerns, conduct materially inconsistent with MyBody's standards, or other circumstances that could undermine the integrity or safety of the platform.

Participation in MyBody does not create an employment, agency, partnership, franchise, or joint-venture relationship between a Guide and MyBody.

8. Guide Profile Fees, Cancellations, and Revisions

Certain Guide profile experiences require a one-time profile creation fee. Any recurring subscription or other ongoing fee will be communicated separately before it applies.

Unless otherwise agreed in writing:

• A Guide may cancel a scheduled profile interview and receive a refund of the profile creation fee if cancellation occurs at least 24 hours before the scheduled interview.
• Once the profile interview has been conducted, the profile creation fee is non-refundable if the Guide chooses not to proceed.
• If, after the interview, MyBody independently decides not to proceed with publishing the Guide, MyBody will refund the profile creation fee.
• One round of profile revisions is included in the profile creation fee.

Additional services or revisions may be subject to separate terms or fees disclosed before purchase.

9. Guide Materials, MyBody Content, and Reuse

Guides retain ownership of photographs, logos, trademarks, pre-existing written materials, and other original materials they provide to MyBody. Guides also retain their rights in the underlying facts, experiences, professional information, methods, and ideas relating to their own work.

By providing materials to MyBody, a Guide grants MyBody a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, adapt, display, publish, and promote those materials as reasonably necessary to create, operate, market, and maintain MyBody and the Guide's participation on the platform.

MyBody retains ownership of its branding, website design, Care Quiz, profile framework and structure, interview and editorial methodology, matching methodology, original editorial work created by MyBody, and other MyBody-created materials, subject to a Guide's rights in their underlying information and contributed materials.

Where a Guide's purchased profile experience expressly includes reuse rights, the Guide may reuse reasonable excerpts of MyBody-created profile copy in their own website, social media, or marketing materials. Unless MyBody agrees otherwise in writing, this does not permit copying or recreating the complete MyBody profile, MyBody's profile structure or template, proprietary questions or methodology, branding, website design, or other elements that would reproduce the MyBody experience outside the platform.

10. Acceptable Use

When using MyBody, you agree not to:

• Use the Services for unlawful, fraudulent, abusive, or harmful purposes.
• Impersonate another person or misrepresent your affiliation with a person or organization.
• Attempt to access information, accounts, systems, or areas of the Services you are not authorized to access.
• Interfere with the security, integrity, or operation of the Services.
• Scrape, harvest, copy, reproduce, or commercially exploit MyBody content or data except as permitted by law or with our written permission.
• Upload or transmit malicious code or otherwise attempt to disrupt the Services.
• Violate the rights or privacy of another person.

11. Intellectual Property

Except for materials owned by Guides or other third parties, the MyBody website, branding, design, text, graphics, Care Quiz, profile format, editorial materials, selection and arrangement of content, and other original MyBody content are owned by MyBody or used with permission and are protected by applicable intellectual-property laws.

You may use MyBody for your personal, noncommercial use. No other rights are granted except as expressly stated in these Terms.

12. Third-Party Websites and Services

MyBody may link to Guide websites, scheduling platforms, social media accounts, payment services, or other third-party services.

We do not control those services and are not responsible for their content, availability, security, privacy practices, terms, or services. Your interactions with third parties are governed by your relationship with them.

13. Adults Only

The Services are intended for individuals age 18 and older. By using the Care Quiz or other Seeker Services, you represent that you are at least 18 years old.

14. Privacy

Our Privacy Policy explains how we collect, use, store, and share personal information. By using the Services, you acknowledge that you have access to the Privacy Policy.

15. Disclaimer of Warranties

To the fullest extent permitted by law, MyBody and the Services are provided on an "as is" and "as available" basis.

We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free, or that any Guide, match, information, modality, or service will meet your needs or produce any particular result.

Nothing in these Terms excludes warranties or consumer protections that cannot legally be excluded.

16. Limitation of Liability

To the fullest extent permitted by applicable law, MyBody and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the Services.

To the fullest extent permitted by applicable law, MyBody is not responsible for the acts, omissions, advice, treatment, services, professional conduct, or outcomes of independent Guides or for interactions between Seekers and Guides.

Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded.

17. Changes to MyBody or These Terms

MyBody is an evolving platform. We may modify, suspend, add, or remove features of the Services and may update these Terms from time to time.

When we update these Terms, we will revise the "Last updated" date above. Where required by law, we will provide additional notice of material changes.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.

18. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law principles, except to the extent applicable law requires otherwise.
